This Privacy Policy explains how Shanda Technologies Inc., doing business as Hilite (“Hilite,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information when you use hellohilite.com, app.hellohilite.com, and our recording, editing, transcription, enhancement, publishing, hosting, analytics, collaboration, support, and related services (collectively, the “Service”).

1. Who we are

Hilite is the controller of the personal information described in this Policy unless we state otherwise. Our legal entity is Shanda Technologies Inc., a Delaware corporation doing business as Hilite.

2. Information we collect

We collect information you provide, including account and profile details; recordings, uploaded audio or video, transcripts, edits, titles, descriptions, show notes, music, images, comments, RSS information, distribution settings, and other User Content; plan, transaction, tax, and payment-status information; support requests, survey responses, feedback, and sales communications; and information about collaborators, guests, or other people that you provide. Full payment-card details are generally processed by Stripe or another payment processor rather than stored by Hilite.

We automatically collect device, network, and usage information, such as IP address, browser and operating system, device identifiers, language, approximate location inferred from IP address, pages viewed, features used, clicks, session activity, referring pages, timestamps, errors, performance data, and account events. We also receive cookie and similar-technology information from cookies, pixels, scripts, software development kits, local storage, and comparable technologies.

We may receive information from third parties, including sign-in providers such as Google, Apple, or Meta; payment and fraud-prevention providers; podcast directories, RSS services, social platforms, or other integrations you connect; and analytics, referral, or marketing partners where permitted by law.

3. How we use information

We use personal information to provide, operate, personalize, and secure the Service; record, upload, transcribe, edit, enhance, generate, store, publish, distribute, and analyze content at your direction; create and manage accounts, subscriptions, trials, invoices, usage limits, and payments; authenticate users and prevent fraud or abuse; troubleshoot errors; respond to support requests; send product, billing, security, and policy notices; analyze performance and improve features; send marketing communications where permitted; comply with law; enforce agreements; and establish, exercise, or defend legal claims.

4. Audio, transcripts, and AI features

Hilite processes recordings, transcripts, prompts, edits, and related metadata to provide the features you request. Relevant content may be transmitted to providers that perform transcription, audio processing, cloud hosting, content generation, or similar functions on Hilite’s behalf. As between you and Hilite, you retain ownership of your User Content.

Unless Hilite separately asks and you agree, Hilite does not use private User Content to train generalized AI models for unrelated customers. You are responsible for having the rights and legally required consents to upload, record, process, and publish information about other people.

5. Legal bases for processing

Where the GDPR, UK GDPR, or similar laws apply, we rely on contract to provide requested services; legitimate interests to operate, secure, improve, and understand the Service, communicate with users, and prevent fraud where those interests are not overridden by your rights; consent for certain cookies, marketing, integrations, or optional processing; and legal obligations for compliance, accounting, tax, and recordkeeping.

6. How we disclose information

We may disclose information to service providers that support cloud hosting, storage, content delivery, transcription, audio processing, AI features, authentication, payments, analytics, customer support, email delivery, security, and website operations. Depending on the feature and current configuration, providers may include AWS, Vercel, Firebase or Supabase, Deepgram, Stripe, Mixpanel, Google Analytics, Intercom, Sanity, and authentication providers.

We may also disclose information to connected services and publishing destinations at your direction; collaborators, guests, team members, or the public when you share, invite, or publish; professional advisers and potential transaction counterparties under appropriate obligations; authorities or other parties when reasonably necessary for law, safety, fraud prevention, or enforcement; and a buyer, successor, or affiliate in a merger, financing, reorganization, acquisition, bankruptcy, or sale of assets.

We do not sell personal information for money. Certain analytics or advertising disclosures may be treated as “sharing,” “targeted advertising,” or a “sale” under some privacy laws. Where those laws apply, we will provide legally required notices and choices.

7. Cookies and similar technologies

We and our providers use cookies and similar technologies for authentication, security, preferences, performance, analytics, customer support, and, where enabled, marketing. Non-essential technologies may require consent in some locations. See our Cookie Policy for more information and available controls.

8. Data retention

We retain personal information for as long as reasonably necessary to provide the Service, maintain accounts, comply with law, resolve disputes, prevent abuse, and enforce agreements. Retention depends on the type of information, purpose, account status, contractual commitments, legal requirements, and backup cycles. Deleted information may remain for a limited period in backups, logs, fraud-prevention systems, or records required by law. Publicly distributed content may remain available through third-party platforms, podcast directories, caches, downloads, or RSS subscribers outside Hilite’s control.

9. Security and international transfers

We use administrative, technical, and organizational safeguards designed to protect personal information, but no system is completely secure. You are responsible for protecting your account and keeping independent backups of important content. Hilite is based in the United States, and information may be processed in the United States and other countries where we or our providers operate. Where required, we use recognized safeguards for international transfers, such as contractual protections or other lawful mechanisms.

10. Your privacy rights

Depending on where you live, you may have rights to access, know, correct, delete, restrict, object to, or obtain a portable copy of personal information; withdraw consent; opt out of certain sales, sharing, targeted advertising, or profiling; limit certain uses of sensitive information; and appeal a denied request. To submit a request, email admin@hellohilite.com with the subject “Privacy Request.” We may verify your identity and authority. We will not unlawfully discriminate against you for exercising a privacy right.

California and other U.S. states

Residents of certain U.S. states may have rights concerning categories and specific pieces of information, deletion, correction, portability, opt-out, limitation of certain sensitive-information uses, and non-discrimination. Sections 2, 3, and 6 summarize the categories we collect, use, and disclose. Hilite does not knowingly sell personal information for money or knowingly sell or share personal information of children under 16. To request an opt-out from disclosures that may qualify as sharing or targeted advertising, use available cookie controls or email admin@hellohilite.com.

European Economic Area, United Kingdom, and Switzerland

You may object to processing based on legitimate interests, request restriction in certain circumstances, withdraw consent, and complain to your local data protection authority. Withdrawing consent does not affect processing that occurred before withdrawal.

11. Children

The Service is not directed to children under 13, and Hilite does not knowingly collect personal information from children under 13. If you believe a child has provided information without appropriate authorization, contact us so we can investigate and take appropriate action.

12. Third-party services

The Service may contain links to or integrations with third-party services. Their privacy practices are governed by their own policies, not this Policy. Review those policies before connecting an account or publishing content.

13. Changes and contact

We may update this Policy to reflect changes in the Service, technology, law, or our practices. We will post the updated version and revise the “Last updated” date. Where required, we will provide additional notice or request consent.
